Lethal force, Non-lethal force options, and Non-lethal home security systems.
In the first installment of this series, we examined the minimum legal threshold required for deploying and using lethal force. Considering the higher-level of criminal and civil scrutiny when lethal force is used, we suggest that non-lethal means of force may offer one or more alternatives more palatable to citizens who not wanting a gun or who wish to avoid the web of potential/likely legal entanglements of using a gun.
In the second part of this series, we examined some of the most common means (not an exhaustive list) of non-lethal force including Taser; Pepper spray/mace; High-intensity light, and security cameras. In each case, we reviewed the purposes, advantages, disadvantages, and cost of each method. Security cameras were included in the list because some people believe that security cameras are means of nonlethal force because they “deter” some criminal activity. In Part II of this series, we suggested that cameras were not a means of non-lethal force.
As crime in America escalates, property crimes in particular are skyrocketing. It is sometimes said that “desperate times lead to desperate measures”. Assuming a steady rate of crime, the increase may be attributable in some part to the desperation people experience for losing the jobs, businesses, and even their homes caused by the economic crisis brought-on by the pandemic with continuous lockdowns.
Fear leads to panic and panic produces some of the worst behavior imaginable. But in an era of tightening gun laws and an almost draconian pursuit of prosecution for even obvious instances of self-defense with a gun, how is a family to protect itself while at home? How do you protect what is likely your family’s single-most valuable asset, your home?
Security cameras are not a means of non-lethal force and non-lethal home security systems.
Let’s begin where we left-off in Part II: Security Cameras. Home security cameras, alarms, and locks are the bulwark of non-lethal home security systems. In addition, very wealthy families or celebrities pay substantial premiums to receive “armed response” by private security guards when their alarms are triggered. (Private security response is often the choice of wealthy families because the response times are typically faster than local police while getting a guard to the premises.) For the vast majority of homeowners, a response by armed security guards is not affordable and probably not advisable without a substantial increase in liability coverage should something go wrong with the armed guards.
This leads to many questions: Without guns or an armed guard response, how do you protect yourself? With average police response times taking up-to 18-minutes and more, will the alarms protect you, and if this is your expectation how will they protect you? Will the cameras protect you? What happens when the expectation of safety and security with cameras and alarms fails to deter a threat? What level of force is available to you to repel the threat without endangering yourself or your family?
Contrary to myth, CCTV or high-definition security cameras (HDTV) is not a form of non-lethal force. (If you think cameras are a form of non-lethal force, just ask anyone with footage of a burglary or home invasion.) Home security cameras and business security cameras merely record the crime, they don’t stop it. Therefore, Security cameras are not representing non-lethal home security systems
In addition, on January 6, 2021, the US Capital was overrun by protesters, some of whom engaged in wanton violence and destruction. It was a horrific event and mimicked similar events in some of the biggest cities in America over the past summer. The point is this: Cameras, alarms, and locks did not stop the threats. The recordings from those cameras are now being used to prosecute offenders, but the damage is done.
Security cameras are just cameras.
Whether it is a home security camera, business or commercial security camera, it makes no difference. Security cameras watch; they don’t record – and don’t do even that without recording software or a separate device to preserve the recording/upload to the cloud. Where people believe that cameras are non-lethal force is based on a false notion of force. While a security camera MAY deter someone who fears being recorded and subsequently caught, the cameras DO NOT exert any physical or physiological force to stop a determined threat; they will not stop or deter a determined attacker. The cameras will, however, record your demise if you have recording capability.
When confronted by a recognizable threat the use of non-lethal force is appropriate. But what will you do? How do you stop a threat or attacker with non-lethal force without confronting the threat, face-to-face? How do you stop the threat and avoid the danger?

Always remember:
- A threat must be current, immediate, and unavoidable.
- Your use of nonlethal force must be appropriate to the threat.

Unlike when using lethal force, if at any point you misjudge the first, exceed the second, or forget the third, you are far-less likely of running the risk of a criminal indictment because the perceived attacker is not permanently harmed; he didn’t die. Everyone involved survived the encounter without permanent physical harm. This, after all, is the point of non-lethal force.
